In March of 2018, Governor Holcomb signed Senate Enrolled Act 52 into law. Under the new law, hemp-based CBD that contains 0.3% or less THC can be sold and used for any purposes within the state. 

In Indiana, only CBD products that have been tested by a third-party lab and packaged with a QR code and that are labeled with specific information are permitted to be sold in the state. CBD products sold in the state must contain:

Marijuana, however, is a different story. Interestingly, in 1913, Indiana was one of the first states to outlaw marijuana sales without a prescription. In the state of Indiana, marijuana is not legal. In fact, the state has some of the most restrictive marijuana laws in the United States. Interestingly, the government in Indiana is considering HB1232, a bill that would decriminalize marijuana, and SB 231, a bill that would set up a medical marijuana program. In 2014, Governor Mike Pence signed bill IC 15-15-13 into law. This legislation, also called the Industrial Hemp Act, allowed licensure for hemp cultivation. The one caveat to the law, however, was that people could only obtain a license for growing hemp if it was for research purposes and done in a partnership with Purdue University. This law did not allow hemp products to be purchased by consumers. As we stated earlier, it was the passing of the 2018 Farm Bill that allowed hemp-derived CBD products to legally be bought and sold throughout the United States. Therefore, the government of Indiana allowed industrial hemp to be grown and harvested in the state. Under SB516, the Indiana Advisory Committee was created. This special committee worked to create guidelines and rules for the state’s hemp program. And by 2019, hemp was made legal to grow and cultivate in Indiana, providing the right path is followed to obtain licensure. 

Are Prescriptions Necessary to Buy CBD Oil in Indiana and is there an Age Requirement?
