CBD Oil in Colorado: Is it Legal and Where to Buy

Buying CBD oil across the United States is easier in some states than it is in others. When it comes to Colorado, however, the state is considered to be one of the most well-informed. In fact, the state was one of the first eight states to make recreational marijuana legal. Even though you can easily shop for CBD online once you find a trusted and well-respected brand, there are still a wealth of places to go shopping for cannabis products in Colorado. It seems that while marijuana is legal in the state, there are still guidelines that must be followed in order to avoid legal ramifications.

CBD in Colorado: Everything You Should Know

Colorado first legalized recreational marijuana in 2012. Since that time, many other states have followed suit. In January of 2018, the state of California followed Colorado’s lead by enabling the sale of recreational marijuana. Because Colorado’s reputation precedes it, the state is one of the most popular places to go for cannabis enthusiasts. The state is one of the best places to be if you intend on buying either marijuana-based or hemp-based CBD products.

Is CBD Legal in Colorado?

The good news is that thanks to the 2018 Farm Bill, hemp-based CBD oils and other types of hemp-derived CBD products are legal to buy and sell throughout the United States as long as they contain 0.3% or less THC. Hemp-derived CBD products are not regulated by the FDA and therefore, are considered food supplements. So, you won’t need a prescription to buy CBD oil and other products made from hemp.

Is Marijuana Legal in Colorado?

Recreational and Medicinal marijuana has been legal in Colorado since 2012. However, if you buy marijuana oil in the state, you’ll have to get it from a local dispensary. Additionally, you’ll need to be 21 or older and show a valid form of identification. If you’re looking for medical advice, then you won’t find it at a recreational dispensary in the state. Only the staff at medicinal dispensaries or double-licensed stores can help guide you through any type of cannabis treatment. In order to purchase medicinal marijuana in Colorado you will need a recommendation from your doctor. All marijuana-based CBD products contain high amounts of THC and will evoke feelings of euphoria. If you’re looking for a more non-intoxicating type of CBD product, then hemp-based CBD products are your best bet.

In 2021, the government in Colorado passed HB 21-1317, which put a daily limit of 8 grams on marijuana. This bill also put in place measures to both educate the state’s youth about marijuana and prevent its misuse in the young. Marijuana was initially prohibited in Colorado from 1917 to 2000. The state’s first anti-marijuana law made growing marijuana a misdemeanor that resulted in 30 days in jail or a $100 fine. In 2019, that fine increased to over $2,125.

In 1975, Colorado legislature decriminalized possession of small amounts of marijuana. Therefore, if you were caught with an ounce of marijuana, you would only receive a maximum fine of $100. Then in the year 2000, the state became the first to legalize medicinal marijuana in its constitution through the passing of Amendment 20. Under this amendment, marijuana became available to people who were diagnosed with chronic weight loss, muscle spasms, seizures, severe pain, and severe nausea. Lastly, under Amendment 64, those who reside in Colorado can grow and harvest up to six plants of their own marijuana and then give away up to one ounce of it.

Where To Buy CBD Oil in Colorado?

It’s legal to purchase both hemp-based and marijuana-based CBD products in Colorado. You will see smoke shops, CBD stores, and Marijuana dispensaries along the road and in shopping centers. It's not very difficult to find a local place that sells CBD, but you should have the understanding that not all brands and products are created equal. Products made from hemp and marijuana are available to consumers both medicinally and recreationally. There’s a big difference, however, in the ways that these two types of products can be purchased. Interestingly, in the city of Denver, CBD products that are made outside of Colorado are not allowed to be sold.

All industrial hemp is governed by the Colorado Department of Agriculture. In 2018, the state’s governor signed a policy that made hemp an agricultural commodity. The state then revamped its laws to allow all parts of the industrial hemp plant to be used as a food ingredient if growers complied with a certain set of rules. If manufacturers wish to use industrial hemp as an ingredient, then they need to register with the Colorado Department of hemp and Environment and be able to show that:

  • The extracts they obtained from the hemp plant’s flowers, stalks, leaves, and stems contain 0.3% or less THC
  • That the hemp their using contains less than 0.3% THC
  • That they’re following all laws within their state or country of origin
  • That the hemp they’re using comes from a state with a verified industrial hemp program or a country that regulates hemp to ensure it’s safe for human consumption

CBD Oil in Colorado: Online Shops vs Local Stores

In the state of Colorado there’s no shortage of brick and mortar stores to buy CBD from. It can be quick and convenient to drive to a store nearest you, and it's always nice to get to see and hold the products in person that you're thinking of purchasing. However, you’ll have more luck finding a larger variety of high-quality CBD products online from a trusted brand.

Moreover, when shopping online, you can take all the time you need to browse brands and products from the comfort of your home without the restriction of store hours. When you visit a store, there’s no guarantee that the employees will be able to answer all of your questions or thoroughly address your concerns. Buying CBD products online allows you to deeply research brands, products, cannabis, and anything else that you have questions about.

What to Look for When Buying CBD Oil in Colorado

When buying CBD oil — whether it’s online or in a store — you should take a few things into consideration. Some important factors to consider are:

  • Where the brand sources its hemp
  • If the brand uses an independent lab to test all of its products
  • Does the brand use the industry-preferred CO2 extraction process to obtain its extracts
  • Can customers find third-party lab reports on the brand’s website
  • If the products are clearly labeled
  • Product ingredients
  • Verified customer reviews

Furthermore, you should avoid brands that make wild and outlandish claims about their products and what they can do. Remember, if it sounds too good to be true, then it probably is.
